Website Terms of Use

These Website Terms of Use (“Terms”) govern your access to and use of arcke.io and its webpages (the “Site”). The Site is operated by Arcke PBC, a Delaware public benefit corporation (“Arcke,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Scope of these Terms
The Site currently provides information about Arcke and allows eligible visitors to join a waitlist.
These Terms do not govern:
- The Arcke Artist Survey at survey.arcke.io, which is subject to the notices and terms presented with that survey;
- The associated survey giveaway, which is subject to its separate official rules; or
- Any future Arcke product, platform, Preview, beta, or other service, which may be governed by separate terms when made available.
If terms specific to another Arcke service conflict with these Terms, the service-specific terms control for that service.
2. Eligibility
The Site and waitlist are intended for people who are at least 18 years old. By using the Site or joining the waitlist, you represent that you are at least 18.
3. Information about the Preview
Descriptions of Arcke’s planned Preview, products, features, availability, timelines, pricing, or capabilities are provided for general informational purposes only.
Arcke is still developing its products. Plans may change, and nothing on the Site constitutes a promise, guarantee, offer, or binding commitment to release any product or feature on any particular date or under any particular terms.
4. Waitlist
You may submit the waitlist form to request an invitation when the Arcke Preview becomes available.
By submitting the form, you:
- Request and consent to receive one email invitation relating to the Arcke Preview;
- Confirm that the information you provide is accurate to the best of your knowledge;
- Confirm that you are authorized to use the email address you provide; and
- Acknowledge that joining the waitlist does not guarantee access, priority, eligibility, or an invitation by any particular date.
Joining the waitlist does not create an account, customer relationship, partnership, agency relationship, or entitlement to use any Arcke product.
Please do not include confidential information, sensitive personal information, trade secrets, or information that you do not have the right to provide in optional form fields.
We may remove invalid, duplicate, fraudulent, or abusive submissions. You may ask to be removed from the waitlist by contacting hello@arcke.io.

5. Acceptable use
You may use the Site only for lawful purposes and in accordance with these Terms.
You must not:
- Interfere with, disrupt, damage, or attempt to gain unauthorized access to the Site or its supporting systems;
- Introduce malware or other harmful code;
- Circumvent security, access, or usage restrictions;
- Use automated systems to scrape, extract, or reproduce Site content without our prior written permission;
- Impersonate another person or misrepresent your affiliation with any person or organization;
- Submit unlawful, misleading, abusive, or infringing material; or
- Use the Site in a way that violates another person’s rights or any applicable law.
We may restrict or block access when we reasonably believe these Terms have been violated or when necessary to protect the Site, Arcke, or others.
6. Intellectual property
The Site and its contents—including text, design, graphics, branding, logos, software, and other materials—are owned by Arcke or used by Arcke under license. They are protected by applicable intellectual-property laws.
Subject to these Terms, Arcke grants you a limited, revocable, non-exclusive, non-transferable right to access and view the Site for your personal or internal informational use.
Except as permitted by law, you may not copy, reproduce, modify, distribute, publish, sell, license, create derivative works from, or commercially exploit any part of the Site without our prior written permission.
“Arcke,” its logos, and associated branding are trademarks or brand assets of Arcke or its licensors. No right to use them is granted except as expressly stated in these Terms.
7. Privacy
Our Privacy Policy explains how we collect, use, retain, and protect personal information. By using the Site or joining the waitlist, you acknowledge that you have had an opportunity to review that policy.
8. No professional advice
Site content is provided for general information only. It does not constitute legal, financial, tax, business, rights-management, royalty, or other professional advice.
You should obtain appropriate professional advice before acting on information relevant to your particular circumstances.
9. Availability and disclaimers
We may change, suspend, restrict, or discontinue any part of the Site at any time.
To the fullest extent permitted by applicable law, the Site and its content are provided “as is” and “as available.” Arcke makes no express or implied warranties concerning the Site, including warranties of accuracy, completeness, availability, security, non-infringement, merchantability, or fitness for a particular purpose.
We do not guarantee that the Site will always be available, uninterrupted, secure, or free from errors or harmful components.
Nothing in these Terms excludes warranties or other rights that cannot lawfully be excluded.
10. Limitation of liability
To the fullest extent permitted by applicable law, Arcke and its officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, opportunity, goodwill, or data, arising from or relating to the Site.
To the fullest extent permitted by applicable law, Arcke’s total liability arising from or relating to the Site or these Terms will not exceed US$100.
These limitations do not apply to liability that cannot lawfully be excluded or limited, including liability for fraud, fraudulent misrepresentation, willful misconduct, or death or personal injury where applicable law prohibits its exclusion.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.
Subject to any rights that cannot lawfully be waived, any dispute arising from or relating to the Site or these Terms must be brought exclusively in the state or federal courts located in Delaware, and you and Arcke consent to their jurisdiction.
If you are a consumer, this section does not deprive you of any mandatory protection or right to bring proceedings available under the laws that apply to you.
12. Changes to these Terms
We may revise these Terms as the Site and Arcke evolve. When we do, we will publish the revised Terms on the Site and update the effective date.
Changes apply prospectively from the stated effective date. Your continued use of the Site after that date constitutes acceptance of the revised Terms where permitted by law.
13. General provisions
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
These Terms, together with the Privacy Policy and any applicable service-specific terms, constitute the agreement between you and Arcke concerning the Site.
